1. Acceptance of Terms
By downloading, installing, accessing, or using the BeeReady application, website, or related services (collectively, the “App” or “Services”), you agree to be bound by these Terms of Service (“Terms”).
If you do not agree to these Terms, do not use BeeReady.
BeeReady may update these Terms from time to time. Continued use of the App after any update constitutes acceptance of the revised Terms.
2. Eligibility
You must be at least the minimum age required under applicable law to use BeeReady.
If you use BeeReady on behalf of another person, including a child, parent, spouse, dependent, or other individual, you represent that you have authority to do so and to enter information on that person’s behalf.

BeeReady is a personal information organization tool designed to help users store and organize emergency-related information, including but not limited to:

BeeReady is provided solely as an informational and organizational tool.
BeeReady is not:
BeeReady does not provide medical advice, legal advice, diagnosis, treatment recommendations, or emergency dispatch services.
Users should always seek appropriate professional advice and emergency assistance when needed.
5. No Medical Advice
Information stored in BeeReady is entered entirely by users and is not reviewed, verified, interpreted, or approved by BeeReady.
BeeReady does not provide medical advice, diagnosis, prognosis, treatment recommendations, medication guidance, emergency triage, or clinical decision support.
All medical decisions should be made in consultation with qualified healthcare professionals.
6. No Doctor–Patient or Professional Relationship
Use of BeeReady does not create a physician–patient relationship, healthcare provider relationship, legal advisory relationship, fiduciary relationship, agency relationship, or any other professional or special relationship between the user and BeeReady or its owners, operators, contractors, developers, licensors, or affiliates.
Nothing in BeeReady should be interpreted as creating any duty of care beyond what is expressly stated in these Terms.
7. HIPAA Disclaimer
BeeReady is not a healthcare provider, health plan, healthcare clearinghouse, business associate, or other entity subject to the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”) solely by virtue of offering the App.
Information entered into BeeReady is stored and managed by the user and is not maintained as part of any regulated medical record system unless expressly stated otherwise.
BeeReady is not intended to store protected health information on behalf of healthcare providers, hospitals, clinics, insurers, or other covered entities.
Users are responsible for determining whether their own use of BeeReady complies with HIPAA or any other healthcare privacy or security laws that may apply to them.
8. Emergency Services Disclaimer
BeeReady is not connected to 911 or any other emergency response service.
BeeReady cannot summon police, fire, ambulance, or medical assistance.
In any emergency, users or bystanders must contact appropriate emergency responders directly. BeeReady does not monitor for emergencies and does not initiate alerts, calls, or notifications to emergency responders, family members, caregivers, or other third parties.
9. No Guarantee of Emergency Response or Access
BeeReady does not guarantee that:
Users should not rely on BeeReady as their sole emergency-preparedness method. Users are solely responsible for determining whether important information stored in BeeReady should also be communicated through other means, including verbal communication, written instructions, printed documents, medical identification devices, or other emergency preparedness measures.
10. User Responsibility for Accuracy and Updates
Users are solely responsible for:

11. Assumption of Risk
Users acknowledge that storing, organizing, exporting, or relying upon emergency-related information in a digital application carries inherent risks, including but not limited to device failure, software malfunction, data loss, inaccessibility, human error, misuse, or misunderstanding.
By using BeeReady, users knowingly and voluntarily assume all risks associated with using the App and any information stored in, generated by, or shared from the App.
12. No Duty to Monitor or Verify
BeeReady has no obligation to monitor, review, verify, edit, correct, validate, or maintain any information entered by users.
BeeReady has no duty to detect outdated, inaccurate, misleading, incomplete, or unsafe information.
Users remain solely responsible for the content they enter and maintain.
13. Device Dependence and Availability
Access to BeeReady information may depend on the condition, settings, availability, and usability of the user’s device.
Information may become inaccessible due to:
BeeReady is not responsible for access limitations caused by any of the above.
14. Local Storage and Information Handling
BeeReady is designed to store information locally on the user’s device unless expressly stated otherwise.
Users understand that local storage may be affected by device settings, operating system behavior, app deletion, resets, upgrades, hardware failure, or user actions.
BeeReady does not guarantee that locally stored information will remain preserved indefinitely.
15. No Storage Guarantee
BeeReady does not guarantee that any information stored in the App will remain available, intact, uncorrupted, retrievable, or preserved for any specific period of time.
Information may become unavailable or be lost for reasons including but not limited to software bugs, operating system updates, device failure, deletion, synchronization errors, corruption, or unauthorized access.
16. Backup Recommendation
Users are encouraged to maintain backup copies of critical emergency information outside the App when appropriate.
Users should not treat BeeReady as the sole repository of life-critical, medical, legal, financial, or emergency-related information.

BeeReady is not responsible for any loss, corruption, inaccessibility, or alteration of information caused by:

While reasonable efforts may be made to maintain app integrity and security, BeeReady cannot and does not guarantee protection against:

BeeReady is not liable for damages caused by such events.
19. Exported, Shared, and Printed Information Disclaimer
BeeReady may allow users to export, print, share, email, message, or otherwise distribute information, including Emergency Packets.
Once information is exported or shared outside the App:
Users are solely responsible for deciding what to export, with whom to share it, and how to protect shared information.
20. Third-Party Access Disclaimer
If users share information with family members, caregivers, physicians, friends, employers, attorneys, responders, or any other third party, users assume all risk related to such sharing.
BeeReady is not responsible for how third parties handle, store, interpret, disclose, or misuse shared information.
21. Printed Packet and Offline Copy Disclaimer
Printed, downloaded, or saved copies of Emergency Packets may become outdated over time.
BeeReady does not guarantee that any printed, exported, or offline version reflects current information unless the user has updated and regenerated that version.
Users are responsible for replacing outdated copies when information changes.
22. Third-Party Services and Platforms
BeeReady may rely on third-party platforms and services, including but not limited to:
BeeReady is not responsible for outages, delays, limitations, bugs, policy changes, incompatibilities, or failures of third-party systems.
23. Service Availability
BeeReady is provided on an “as is” and “as available” basis.
BeeReady does not guarantee uninterrupted service, continuous operation, compatibility with all devices or operating systems, or freedom from defects or errors.
BeeReady may be updated, modified, suspended, restricted, or discontinued at any time, with or without notice. BeeReady has no obligation to maintain backward compatibility with future operating systems, devices, or third-party platforms. BeeReady has no obligation to maintain compatibility with future operating systems, device hardware, or third-party platforms and may cease functioning on certain devices or software environments as technologies evolve.
24. Limitation of Liability
To the fullest extent permitted by law, BeeReady and its owners, operators, developers, licensors, contractors, affiliates, successors, and assigns shall not be liable for any damages, losses, liabilities, claims, costs, or expenses arising from or related to the use of or inability to use the App, whether arising in contract, tort, negligence, strict liability, or otherwise, and whether foreseeable or unforeseeable, including but not limited to:
• personal injury
• death
• medical complications
• emergency-response delays or failures
• failure to contact emergency responders
• failure of third parties to access or use information
• lost opportunities
• emotional distress
• data loss
• property damage
• financial loss
25. Exclusion of Indirect and Consequential Damages
To the fullest extent permitted by law, BeeReady shall not be liable for any indirect, incidental, special, exemplary, punitive, or consequential damages, even if advised of the possibility of such damages.
26. Cap on Liability
If BeeReady is found liable for any claim despite these Terms, BeeReady’s total aggregate liability for any and all claims arising out of or related to the App, whether arising in contract, tort, negligence, strict liability, or otherwise, shall not exceed the amount the user paid, if any, for use of the App during the twelve months preceding the event giving rise to the claim.
If the user paid nothing for use of the App, BeeReady’s total aggregate liability shall not exceed one hundred U.S. dollars (US $100) or the minimum amount permitted by applicable law, whichever is greater.
27. No Warranty
BeeReady is provided without warranties of any kind, express or implied, including but not limited to warranties of:
Users assume all risk associated with use of the App.
28. Indemnification and Hold Harmless
Users agree to indemnify, defend, and hold harmless BeeReady and its owners, operators, developers, licensors, contractors, affiliates, successors, and assigns from and against any claims, damages, liabilities, judgments, losses, costs, and expenses, including reasonable attorneys’ fees, arising from or related to:
• user-entered information
• use or misuse of the App
• sharing or exporting information
• reliance by the user or any third party on information stored in or exported from the App
• violation of these Terms
• violation of applicable law
This indemnification obligation includes claims brought by third parties alleging injury, damages, or losses arising from information stored in or exported from the App.

Users agree not to use BeeReady to:

All software, code, visual design, branding, names, marks, text, graphics, and other content associated with BeeReady are protected by intellectual property laws.
Except as expressly permitted, users may not copy, modify, distribute, license, reverse engineer, decompile, disassemble, create derivative works from, or exploit BeeReady or its contents.
31. Export Compliance
Users agree to comply with all applicable export control and sanctions laws in connection with use of the App.
Users represent that they are not located in, under the control of, or a national or resident of any country or region subject to applicable restrictions, if such restrictions apply.
32. Electronic Communications
By using BeeReady, users consent to receive communications electronically, including notices, disclosures, and updates relating to the App or these Terms, where permitted by law.
33. Feedback
If users provide suggestions, ideas, comments, feature requests, or other feedback regarding BeeReady, users grant BeeReady a perpetual, irrevocable, worldwide, royalty-free right to use and incorporate that feedback without restriction or compensation.
34. Force Majeure
BeeReady shall not be liable for any delay or failure in performance caused by circumstances beyond reasonable control, including but not limited to:

BeeReady may assign, transfer, delegate, or otherwise dispose of its rights or obligations under these Terms without restriction, including in connection with a merger, acquisition, sale of assets, financing, or corporate reorganization.
Users may not assign their rights or obligations under these Terms without prior written consent.
36. Termination or Suspension
BeeReady reserves the right to suspend, restrict, or terminate access to the App or Services at any time, with or without notice, for any reason or no reason, including suspected misuse, security concerns, legal concerns, or operational reasons.
37. Geographic Limitation
BeeReady makes no representation that the App or Services are appropriate, lawful, or available for use in all jurisdictions.
Users access BeeReady at their own initiative and are responsible for compliance with applicable local laws.
38. No Agency, Partnership, or Fiduciary Relationship
Nothing in these Terms creates any agency, partnership, joint venture, employment, fiduciary, or similar relationship between the user and BeeReady.
39. Dispute Resolution
To the fullest extent permitted by law, any dispute, claim, or controversy arising out of or relating to BeeReady, the App, the Services, or these Terms shall first be attempted to be resolved informally by contacting BeeReady.
If the dispute cannot be resolved informally, the dispute shall be resolved through binding arbitration conducted in Collin County, Texas, administered by the American Arbitration Association in accordance with the rules applicable to the dispute and the laws of the State of Texas.
Nothing in this section shall prevent BeeReady from seeking injunctive or equitable relief in a court of competent jurisdiction located in Collin County, Texas where necessary to protect its rights, intellectual property, or operations.
Users agree that arbitration or court proceedings shall occur in Collin County, Texas, unless otherwise required by applicable law.
40. Class Action Waiver
To the fullest extent permitted by law, users agree that any claims will be brought only in an individual capacity and not as a plaintiff or class member in any purported class, collective, representative, or consolidated proceeding.
41. Survival
Any provisions that by their nature should survive termination shall survive, including but not limited to provisions relating to limitation of liability, no warranty, indemnification, arbitration, dispute resolution, class action waiver, intellectual property, and governing law.
42. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect to the fullest extent permitted by law.
43. Entire Agreement
These Terms, together with any referenced policies, constitute the entire agreement between the user and BeeReady concerning the App and supersede prior or contemporaneous understandings regarding the same subject matter.
44. Governing Law and Venue
These Terms and any dispute, claim, or controversy arising out of or relating to BeeReady, the App, the Services, or these Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict-of-law principles.
Subject to the arbitration requirements in Section 39, and to the fullest extent permitted by law, the exclusive venue for any legal action or proceeding arising out of or relating to these Terms or the use of BeeReady shall be the state or federal courts located in Collin County, Texas, and users consent to the jurisdiction of such courts.
The indemnification obligations described in Section 28 extend to claims made by third parties, including but not limited to family members, caregivers, medical professionals, emergency responders, or any other individuals who rely on or access information stored in or exported from the App.
Users acknowledge that the use of digital applications to store or organize emergency, medical, or personal information carries inherent risks. These risks include but are not limited to device malfunction, delayed access to information, outdated information, human error, software defects, and reliance by third parties on information that may be incomplete or misunderstood.
By using BeeReady, users knowingly and voluntarily assume all risks associated with storing, managing, exporting, or relying on information within the App.
BeeReady has no obligation to monitor user-entered information or to warn users or third parties about medical conditions, risks, emergencies, or changes in user information.
BeeReady does not provide alerts, medical monitoring, or real-time safety notifications, and users acknowledge that BeeReady has no duty to notify any person or authority about any information stored in the App.
Users acknowledge that BeeReady is not designed to replace emergency planning, medical identification systems, or professional emergency services.
Users remain responsible for ensuring that appropriate emergency information is communicated to family members, caregivers, and emergency responders through appropriate means.
Users acknowledge that all decisions related to medical care, emergency response, or personal safety must be made independently or in consultation with qualified professionals.
BeeReady does not influence, direct, or control decisions made by users or third parties based on information stored in the App.
50. Waiver of Certain Claims
To the fullest extent permitted by law, users waive, release, and discharge any claims against BeeReady arising from:
• reliance on information stored in the App
• failure of the App to provide emergency assistance
• inability to access stored information
• interpretation or misuse of information by third parties
• delays or failures in emergency response.
The disclaimers, limitations of liability, indemnification obligations, and risk acknowledgments contained in these Terms are fundamental elements of the agreement between BeeReady and the user.
Users acknowledge that BeeReady would not provide the App without these limitations.
